Our client was a Longshoreman working alongside a scrap metal barge docked in the Mississippi River outside of a terminal in Arkansas. One afternoon, while working for his Longshore employer, a cable snapped and whiplashed our client, violently thrusting him and two other co-workers across the barge. Due to the severity of his injuries, our client was immediately taken to the hospital for emergent treatment. He underwent surgery for his spinal injuries and had to remain under supervised physician care for the next several weeks. Unfortunately, and despite his medical treatment, our client was completely restricted from returning to work for over a year. He was eventually deemed capable of returning to work in a significantly lesser capacity, but had already reached retirement age by that time. After a successful mediation, the Longshore Employer and its Carrier agreed to pay $500,000 to resolve the claim, which allowed our client to get the future medical treatment he may need, and to care for his family when he couldn’t return to his prior position.
