The firm obtained a settlement of $250,000 on behalf of a homeowner whose home suffered extensive damage as a result of a busted pipe hidden in a crawlspace, requiring her to relocate to a different residence for over a year.
The client’s homeowner’s insurance company denied the claim after its adjuster visited the property but failed to perform any meaningful property inspection. As reasons for denial of coverage, the insurer claimed the damage was caused by weather conditions, settling of the foundation, wear and tear, and neglect of the insured to use reasonable means to preserve the property, all of which lacked any evidentiary support.
The case was litigated in state court for almost two years and the firm handled extensive discovery, motion practice, and trial preparation before settlement was reached.
