The firm obtained a settlement of $675,000 on behalf of homeowners whose family home suffered extensive damage as a result of a busted hidden pipe. The insurance company denied the claim and materially misrepresented the policy language.
Of note, the insurer represented to the firm’s clients that water leaks that were unknown to the insured and hidden within the wall and ceiling cavities were excluded from coverage under the policy, when the exact opposite was true. The insurer also denied coverage based on the wear and tear exclusion and the faulty, inadequate or defective maintenance exclusion, of which it had no evidence as testified to by its corporate representative.
The case was litigated in state court for four years and the firm handled extensive discovery, motion practice, and trial preparation before settlement was reached.
